SPONSOR: This Promotion is sponsored by Minnesota Public Radio, 480 Cedar Street, St. Paul, MN 55101. (“Sponsor”).
ELIGIBILITY: The Promotion is open only to legal adult residents of the 50 United States (including District of Columbia) who are 21 or older in their state or jurisdiction of residence at the time of entry. Employees of Sponsor, New Belgium and their parent companies, affiliates, franchisees, sales representatives, distributors, agents, and vendors involved with this promotion, and the immediate family and household members of all such employees, are not eligible to enter or win. Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited by law.
PROMOTION TIMING: The Promotion will begin on or about February 18, 2025 when Sponsor posts its initial social media message announcing the availability of ticket prizes and end on either February 21, 2025 or when the final tickets are distributed, whichever is sooner (the “Entry Period”).
HOW TO ENTER: During the Entry Period, Sponsor will periodically post clues via its social media channels to the location where a pair of tickets are located. The first eligible participant to locate the tickets, as determined by the facilitator of the ticket giveaway in its sole discretion, will be awarded those tickets. Just follow Sponsor’s social media pages at @thecurrent on Facebook and Instagram, and @newbelgiumnorthwoods on Instagram during the Entry Period to participate by following the clues provided by Sponsor and try to be the first to find the location where a prize is located. Only one prize per person.
By entering, you agree that any information collected in connection with the Promotion may be used by Sponsor for the intended purposes outlined herein.
PRIZES: A total of four (4) prizes are available. Each prize consists of two tickets to see the Winter Dig Out concert at The Hook & Ladder Theater & Lounge (“Venue”) in Minneapolis, MN on Saturday, February 22, 2025 and merchandise from The Current and Voodoo Ranger. Approximate retail value of each prize: $165.
Winner, on behalf of winner and guest, waive and release any potential claims against Sponsor and the Promotion Entities related to participating in the Promotion, receiving a prize and attending the event.
Prize winner’s guest must be at least the age of 21 in his/her jurisdiction of residence. Concert dates and times are determined in the sole discretion of the Venue operators and may be subject to change. Sponsor is not responsible if the potential winner is not available on the date of the Winter Dig Out concert. The terms and conditions of the tickets awarded as part of the prize will govern if the event is not held on the specified dates, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Participants, prize winners and their guests agree to comply with all applicable rules and regulations of the concert Venue and the facilities where prizes are being facilitated. Sponsor and the applicable Venue or facility reserve the right to remove or to deny entry to a participant or prize winner and/or his/her guest who engage(s) in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event or at any associated facility where tickets are being distributed. In such situation, the prizes will be forfeited. Sponsor, Venue, facilities and the Promotion Entities will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster or disturbances outside their control which may cause the cancellation or postponement of the event or difficulty in retrieving tickets from the facility location. Concert tickets awarded as prizes may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture and may invalidate the license granted by the event tickets.
Prize must be accepted as awarded, and prize is awarded “AS IS” with no warranty, representation or guarantee, express or implied, in fact or in law, made by Sponsor or for which Sponsor shall be liable, including, without limitation, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. Prizes consist only of items specifically listed as part of the prize or as agreed upon by Sponsor in writing. Certain conditions and restrictions may apply, specifically including without limitation any restrictions printed on the tickets and any rules and regulations of the Venue. All costs and expenses not specified herein, related to the prize or incurred by accepting or enjoying a prize, are the sole responsibility of the winner and guest, including without limitation additional travel costs, meals, parking, and any other expenses incurred in use of the prize. No substitution, cash equivalent, assignment or transfer of a prize is permitted, except by Sponsor, who reserves the right to substitute a prize with another prize of greater or equal value. Winner is solely responsible for any and all costs, fees, taxes and expenses associated with prize award, receipt and use, including, without limitation, all federal, state and local taxes on the prize. If the winner does not wish to accept the prize, an alternate winner may be selected at random from the pool of eligible entrants. All details of the prize not set forth herein will be determined by Sponsor in its sole discretion. All winners are subject to verification prior to the awarding of a prize, as are the eligibility, age and other claims of information provided by a potential prize winner and guest.
WINNER SELECTION: Each potential winner will be the person who first deciphers the clues about the whereabouts of a prize and presents himself/herself to the person facilitating the prize giveaway at the applicable prize location. Each prize will be awarded on a first-come, first-served basis in the sole discretion of the prize facilitator. Any disputes regarding the participant who was first to claim the prize will be decided by the prize facilitator onsite in its sole discretion, and Sponsor and facilitator will not respond to any complaints or arguments from participants who did not win. Each prize will be awarded directly to the winner by the prize facilitator in real-time at the prize location.
If any prize is returned, a requested response is not received by Sponsor in the required timeframe, the potential winner cannot use the prize or the original potential winner is deemed ineligible for any reason, the original potential winner will forfeit the prize in its entirety and the prize may be awarded by Sponsor via a new location. The potential winner and guest may be required to complete and return an affidavit of eligibility, liability release, publicity release (if not prohibited by law), and any other necessary documents, including any required tax documents (collectively the “Documents”), within the time specified in the Documents or the prize will be forfeited in its entirety. Award of prize and confirmation of winner is contingent upon potential winner’s qualification and compliance with these Official Rules.
PUBLICITY RELEASE: Except where prohibited, participation in this Promotion and acceptance of a prize constitutes winner’s consent that his/her name, likeness, posts, comments, voice and/or biographical data may be used in any medium for advertising and promotional purposes without limitation and without additional notice, compensation or consent.
LIABILITY LIMITATIONS: If for any reason the Promotion is not capable of running as planned, including without limitation disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, factors beyond Sponsor’s reasonable control, or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Promotion, Sponsor reserves the right at its sole discretion to disqualify any individual that Sponsor deems responsible. In such situations, Sponsor further reserves the right, but shall have no obligation, to cancel, terminate, modify or suspend the Promotion, and substitute an appropriate alternate method of entry and prize award selection.
Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of materials, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE, ANY ASSOCIATED PHYSICAL LOCATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
LIABILITY RELEASE: By entering, participants agree to accept and abide by the Official Rules of this Promotion and agree that any dispute with regard to the conduct of this Promotion, rule interpretation or award of a prize, shall be resolved by Sponsor or the prize facilitator whose decisions shall be binding and final.
By participating, participants and winners agree to release and hold harmless Sponsor, New Belgium, prize facilitators, Venue, any relevant social media channels, related promotional retail partners and each of their respective parent companies, affiliates, subsidiaries, franchisees, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations (“Promotion Entities”) from any injury, loss or damage to person, including but not limited to death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize, participation in any Promotion-related activity, or participation in the Promotion.
DISPUTE RESOLUTION/CHOICE OF LAW: Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of the State of Minnesota. All disputes arising out of or connected with this Promotion will be resolved individually, and without resort to class action, exclusively by the appropriate federal or Minnesota State Court. Should there be a conflict between the laws of the State of Minnesota and any other laws, the conflict will be resolved in favor of the laws of the State of Minnesota. All judgments or awards shall be limited to actual incurred out-of-pocket expenses (excluding attorneys' fees) associated with participation in this Promotion and shall not include any indirect, punitive, incidental and/or consequential damages.
